DMCA Policy
Rustic Dwelling is committed to respecting the intellectual property rights of others. We comply with the provisions of the Digital Millennium Copyright Act (DMCA), 17 U.S.C. ยง 512, and promptly process notices of alleged copyright infringement. This policy outlines the procedures for copyright owners to report alleged infringements and for users to submit counter-notifications if their content has been mistakenly removed.
It is our policy to respond to clear notices of alleged copyright infringement that comply with the DMCA. If you are a copyright owner or an agent thereof and believe that any content hosted on our site infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Copyright Agent with the following information in writing:
Filing a DMCA Notice of Infringement
- Identification of the copyrighted work claimed to have been infringed: Provide sufficient detail, such as a URL or a description of the work, and include a copy or the location (e.g., URL) of the original copyrighted work.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled: Provide the exact URL(s) or other specific location(s) on Rustic Dwelling where the infringing material is located.
- Information reasonably sufficient to permit Rustic Dwelling to contact the complaining party: This includes your name, address, telephone number, and, if available, an email address.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest.
Upon receipt of a valid DMCA notice, Rustic Dwelling will promptly remove or disable access to the infringing material and take reasonable steps to notify the user who posted the content that the material has been removed or disabled.
Counter-Notification
If you believe that your content was removed or access to it was disabled by mistake or misidentification, you have the right to submit a counter-notification to our Copyright Agent. To be effective, a counter-notification must be a written communication that includes substantially the following:
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Rustic Dwelling may be found, and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
- Your electronic or physical signature.
Upon receipt of a valid counter-notification, Rustic Dwelling will provide the complaining party with a copy of the counter-notification. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notification, at Rustic Dwelling's sole discretion.
